How do I make a personal injury claim?

A personal injury claim must be made within 3 years of the date of the accident, or before your 21st birthday if the accident occurred whilst you were under the age of 18.

The action required will depend on the severity of your injuries, and the type of accident you have been involved in.

The majority of personal injury claims, but not all, will be uploaded onto the Personal Injury Portal. The Defendant’s insurers will then undertake investigations, and provide us with their liability position.

If liability is admitted, we will need to obtain medical evidence detailing the injuries you have sustained, and your likely prognosis. This evidence will allow us to value your claim, and put forward a settlement offer, which would include the damages for your injuries, as well as any financial losses you have incurred such as your loss of earnings.

If liability is denied, court proceedings may be needed to determine the issue of liability, and any damages that should be awarded.

What constitutes a personal injury claim?

A personal injury claim arises when someone suffers physical harm or a psychological injury as a result of someone else’s negligence. There are four elements that make up a successful personal injury claim.

  • The Defendant must have owed you a duty of care. For example, a duty of care commonly arises between drivers and other road users, and employers and employees.

This duty of care must have been breached by the Defendant’s negligence.

  • You must have suffered physical injury, or a recognised psychiatric condition.
  • Finally, you must be able to prove that the breach directly caused the injuries you sustained.
How long will a personal injury claim take?

The length of time a personal injury claim takes from start to completion can vary significantly due to number of different factors, the main factors are;

  • Whether or not liability is admitted at the outset
  • How significant the injuries are
  • Whether court proceedings are required

In claims where liability is admitted from the outset and the claimant has only suffered reasonably minor injuries, a claim can  be settled in as little as 6 months. However, in a claim where liability is in dispute and court proceedings are required, or where a claimant has suffered significant injuries which require the involvement of several medical experts, a claim can take upwards of 2-3 years to settle. The length of claim will depend entirely on the individual circumstances of your claim and the injuries you have suffered.
